Note: Registration of Bidders shall be a requirement and will be done at the time indicated below. All prospective bidders must be aware that proper personal identification and a minimum deposit per properties will be required at the time and place of the auction. In the event that the highest bidder chooses to withdraw from the sale For ANY REASON, Please Be Advised That the DEPOSIT Will Be Forfeited. Also be further advised that due to various circumstances, such as present condition of the some properties, the Town of
Fairhaven cannot guarantee access to the properties. No Representation as to the Occupancy of Condition of the Properties are Made and Potential Bidders are Strongly Recommended to Attend Any of the Viewing of the Properties to Determine the Current (As Is) Condition of the Properties. It is strongly recommended that all bidders perform all their own" due diligence" prior to the auction. Please call The Town Treasurer (508-979-4026) who will conduct the Auction viewing of the referenced properties as follow. Inquires
of any viewings times for the property should be directed to the Town Treasurer.
TERMS OF SALE: A minimum deposit for Land and/or Buildings will be required to be paid by bank or certified check at the time and place of the auction as earnest money (bank or certified check must be made
payable to the prospective bidder, and endorsed by the accepted bidder to the Town of Fairhaven immediately after the conclusion of the auction). The balance of the Purchase Price is to be paid by certified or bank check within 21 days of the Sale. Time is the Essence. Prospective bidders must have no outstanding indebtedness with the Town of Fairhaven, Mass. Said property will be sold "AS IS, WHERE IS" and without representation or warranty as to its conditions, constitution of fitness for habitation. The accepted bidder is required to sign a Memorandum of Sale executed at the time of the Auction. In the event that the accepted bidder is unable for any reason to complete the purchase of the property the Custodian reserves the right to sell the property by Treasurer Deed to the said second highest bidder, provided the second highest bidder, shall deposit with the Custodian, the amount of the required deposit as set forth within five (5) business days after receipt of written notice of the default of the previous highest bidder and title shall be conveyed to the said highest bidder within 21 days of the required deposit. Further the Custodian reserves the right to postpone the Sale to a later time and date by public proclamation. Deposits made by unsuccessful bidders will be returned to the unsuccessful bidders at the completion of the auction. The Towns primary objective of the sale is to get these parcels back on the tax roll and generate annual revenue for the Town. The Custodian has the right to accept or reject any or all bids.Other terms to be announced at the sale if any.
