Notice is hereby given that the Town of Wareham, acting and through its Custodian of Tax Possession (The Custodian) in accordance with the provisions of Massachusetts General Laws, Chapter 60, Section 77 A and 77B will sell by Public Auction the following parcels of real property with all rights, title, and interest herewith on the 22nd day of May 2010, said Public Auction will take place at the Town Hall of Wareham.

Note: Registration of Bidders shall be a requirement and will be done at the time indicated below. All prospective bidders must be aware that proper personal identification and a minimum deposit per property will be required at the time of the auction. In the event that the highest bidder chooses to withdraw from the sale For Any Reason, Please Be Advised That the Deposit Will Be Forfeited. No Representation as to the of Condition of each Property is Made and Potential Bidders are Strongly Recommended to Determine the Current (As Is) Condition of Each Property. It is strongly recommended that all bidders perform all their own," due diligence" prior to the auction.

Non-Refundable deposit on each of the above parcels is $ 2,500 Certified or Bank Check, except 34 Twelfth Street, 10 Fannies Lane, 1 Sycamore Avenue and 16 Wareham Avenue, which have a $ 5,000 Non-Refundable Certified or Bank Check deposit.

The Custodian Reserves The Right to Accept or Reject Any and All Bids:

TERMS OF SALE: A minimum deposit for Land will be required to be paid by bank or certified check at the time and place of the auction as earnest money (bank or certified check must be made payable to the prospective bidder, and endorsed by the accepted bidder to the Town of Wareham immediately after the conclusion of the auction). The balance of the Purchase Price is to be paid by certified or bank check within 30 days of the Sale. Time is of the Essence. Prospective bidders must have no outstanding indebtedness with the Town of Wareham. Said property will be sold "As is, Where is" and without representation or warranty as to its condition, or fitness for habitation. The successful bidder will be required to execute a Disclosure Statement as required G.L. c. 7 Section 40J and an Arson/Tax Delinquency Statement in addition to the Memorandum of Sale at the time of the Auction. Pro forma taxes and the recording fee for the deed will be collected at the closing. The successful bidder is not required to pay any of the back taxes. However, the successful bidder will be required to pay taxes from the date the successful bidder delivers the balance of the purchase price to the Town through June 30, 2011. In the event that the accepted bidder is unable for any reason to complete the purchase of the property the Custodian reserves the right to sell the property by Treasurer's Deed to the second highest bidder, provided the second highest bidder, shall deposit with the Custodian, the amount of the required deposit as set forth within five (5) business days after receipt of written notice of the default of the previous highest bidder and title shall be conveyed to the said highest bidder within 30 days of the required deposit. Further the Custodian reserves the right to postpone the Sale to a later time and date by public proclamation. Deposits made by unsuccessful bidders will be returned to the unsuccessful bidders at the completion of the auction. Other terms to be announced at the sale if any.
