Our client a local lending institution holds the mortgage on the remaining 39 lots of this 50 lot development for 55 and older community. It includes two unoccupied units and an additional 37 lots, which has all roads and utilities in place. The two unoccupied units have two bedrooms, two baths, kitchen, living room, den and two car garage with approx. 1,400 sq. ft. of living.(Lot 26 aka 81 Clubhouse Circle & Lot 45 aka 138 Clubhouse Circle). Also being sold are Lots # 2,3,4,5,6,8,9,11,12,14,15,16,17,18,19,20,21,22,23, 24,25,27,28,30,31,32,33,35,37,38,39,40,41,42,43,46, and 48 as shown on Bristol (N.D.) Reg. of Deeds in Plan Book 435, Page 58.

*Sale #1 Lot 26 (81 Clubhouse Circle) which is improved by a single family home will be sold separately commencing at 11:00 A.M.
*Sale # 2 Lot 45 (138 Clubhouse Circle)which is improved by a single family home will be sold separately commencing at 11:15 A.M.
*Sale # 3 In one group the premises will be offered for sale for the aggregate remaining Lots 2,3,4,5,6,8,9,11,12,14,15,16,17,18,19,20,21,22,23,24, 25,27,28,30,31,32,33,35,3738,39,40,41, 42, 43, 46, and 48 commencing at 11:30 A.M.
*Sale # 4 Commencing at 12:00 Noon after the above Lots has been offered for sale the mortgaged premises that are subject to this foreclosure auction will be sold in its entirety at one single sale at public auction.

If the highest bids of the mortgaged premises on the Single Sales shall equal or exceed the cumulative total of the highest bids at which the Lots would be sold at the earlier separate Sales (First, Second Sale and Third Sale as described above), then the separate sales for the First, Second and Third sale shall be voided and any deposits paid therefore returned to the highest bidders, and shall be knocked down to the highest bidder of the Single Sale for all the Lots. If the highest bids for the sale of the First, Second and Third Sale under the separate sales, then the Lots will be sold to the highest bidder under the First, Second and Third Sale.

TERMS:The highest bidder under the First and Second Sale shall be required to deposit cash, certified or bank cashier’s check in the amount of Five Thousand ($5,000) Dollars at the time and place of the sale of each individual Lot 26 & Lot45, and if that portion of the mortgaged premises contained in said Mortgage shall be sold by the Third Sale or Single Sale as set forth above, the bidder shall be required to deposit Twenty Thousand ($20,000) Dollars by certified or bank cashier’s check; Balance in thirty (30) days upon delivery of the deed to the Firm Halloran.
